Setback for the Ministry of the Environment before the Privy Council and victory for the NGO Eco-Sud. The Law Lords dismiss the Ministry's appeal and confirm that the Supreme Court was right to overturn the decision of the Environment Court. The latter had ruled that the NGO Eco-Sud had no right to challenge the Pointe-d'Esny Lakeside project.
The environment is everyone's business. From now on, it will no longer be necessary for an organisation campaigning for the environment to have to prove that its financial or economic interests are affected by any project. The British judges also deplored the fact that the project had continued despite the legal disputes.
